Terms & Conditions
Last Updated: September 27, 2026
These Terms & Conditions ("Terms") govern use of SamiraCaleb.com and purchases from Samira & Caleb LLC, operating as Samira and Caleb ("we," "us," or "our"), a business based in Harris County, Texas. We offer physical and digital planners, journals, stationery, and related educational content for adults in the United States.
Please review these Terms before using our website or purchasing a product. By affirmatively accepting these Terms at checkout or through another acceptance mechanism, you agree to them. If you do not agree, do not complete a purchase requiring
acceptance. Nothing in these Terms limits consumer rights that cannot lawfully be waived.
You must be at least 18 years old and able to enter into a binding agreement to purchase from us. You agree to provide accurate contact, billing, and delivery information and to use an authorized payment method.
Product descriptions identify whether an item is physical or digital and describe its included features. A digital purchase does not include a physical product unless expressly stated. Any required software, compatible devices, or third-party subscriptions are your responsibility unless expressly included in the listing.
We aim to describe our products accurately. Colors may vary with screen settings and printing. Such variations do not excuse delivery of an incorrect, defective, or materially misdescribed product.
Products and promotions are subject to availability. Changes to future offerings do not reduce rights relating to an order we have already accepted.
Prices are stated in U.S. dollars unless expressly indicated otherwise. Applicable taxes, shipping charges, and other fees are disclosed before you submit your order. Prices may change for future purchases, but we will not increase the price of an accepted order without your agreement.
Payment is due at checkout unless the checkout expressly provides otherwise. Payments are processed through Stripe, and our website and customer communications use GoHighLevel. You authorize the charge shown at checkout to your selected payment method.
An automated order acknowledgment confirms receipt of your order. We accept an order when we confirm acceptance, ship the physical product, or provide access to the digital product. We may decline or cancel an order for legitimate reasons, including unavailable inventory, payment failure, suspected fraud, or a material pricing error. We will notify you and promptly refund any payment collected for a canceled item. We will not substitute a product or charge a corrected price without your agreement.
Discounts and promotional codes are subject to the conditions disclosed with the offer. A promotion does not apply retroactively unless we expressly state otherwise.
Available shipping destinations, charges, and any shipping timeframes are provided on the product page or at checkout. Please review your delivery address carefully and contact [email protected] promptly if a correction is needed.
We will ship physical products within the timeframe represented when you order. If no shipping timeframe is stated, we will ship within 30 days after receiving a properly completed order, as required by applicable law. If we cannot ship on time, we will provide the required delay notice and cancellation option, obtain any required consent to the delay, or cancel and issue a prompt refund for the unshipped merchandise.
Preorders will be identified as such, with an estimated shipping timeframe provided before purchase. Preorder payments are collected at checkout unless otherwise disclosed. The same applicable delay, cancellation, and refund protections apply to preorders.
Carrier delivery estimates are distinct from our shipping commitments. If a package is lost, damaged, or marked delivered but not received, contact [email protected] so we can investigate and provide an appropriate resolution consistent with applicable law. These Terms do not automatically transfer all risk of loss to you when a package is handed to a carrier.
Digital products are delivered electronically through the method described in the product listing or checkout, such as a download link or access email. Check the stated file format and compatibility requirements before buying. If you cannot access a purchased file, contact [email protected] for assistance.
Upon payment, we grant you a limited, non-exclusive license to download and use the purchased digital product for your own personal, non-commercial use. You may keep backup copies, use it on your own compatible devices, and print copies for your personal use unless the listing states a different permitted use.
You may not share or publicly upload the digital files, distribute copies, resell or sublicense them, or reproduce their content for commercial use without our prior written permission. This restriction does not limit rights that applicable law independently permits. Purchasing a digital product does not transfer ownership of its underlying intellectual property.
You retain ownership of your original journal entries and personal reflections. We do not receive or review those entries as part of your ordinary use of our products. Any third-party app you choose to use to complete or store entries is governed by that provider's terms and privacy practices.
Unless the product listing expressly promises them, a purchase does not include future editions, ongoing updates, or compatibility with every future version of third-party software.
Physical products: All sales are final. We do not accept returns or exchanges unless the product is defective, except where otherwise required by applicable law. Change of mind or a preference for a different product does not qualify for a return.
Digital products: All digital-download sales are final, except for defective digital products or where a refund is required by applicable law. Please review the stated file format and compatibility requirements before purchasing.
Order cancellations: Orders cannot be canceled by the customer once placed, including orders that have not yet shipped and preorders, except where cancellation rights are required by applicable law, including the shipping-delay protections described in Section 3.
Defective products: If you receive a defective physical or digital product, email [email protected] promptly with your order number and a description of the defect. We may request photographs or other reasonable information to assess the issue. We will review the claim and arrange an appropriate correction, replacement, or refund consistent with applicable law. Contact us for return instructions before sending back a physical product. Do not include payment-card details, completed journal entries, or other sensitive personal information in your request.
Nothing in this policy limits remedies required by law for defective, incorrect, undelivered, or materially misdescribed products, or cancellation and refund rights for shipping delays. A later policy change does not retroactively reduce the rights associated with an existing order.
Our products and website provide general educational and self-reflection content relating to planning, personal growth, entrepreneurship, and an ownership mindset. They do not provide individualized medical, mental health, legal, tax, financial, or investment advice and do not create a professional-client relationship.
Consult an appropriately qualified professional about your particular circumstances. References to authors, books, or other resources do not imply endorsement, sponsorship, or affiliation unless expressly stated.
We do not guarantee any particular personal, emotional, business, financial, or investment outcome. Testimonials describe individual experiences and are not promises that you will obtain the same results.
Our website content, product designs, text, graphics, logos, and digital materials are owned by or licensed to Samira & Caleb LLC, except where otherwise identified. They are protected by applicable intellectual property laws.
You may access the website for lawful personal use. Except as permitted by Section 4, our written permission, or applicable law, you may not reproduce, distribute, commercially exploit, or create derivative products from our protected materials. These restrictions do not transfer ownership of your original writing to us or prohibit lawful resale of a physical copy you own.
You must not introduce malicious code, attempt unauthorized access, interfere with website operations, commit fraud, or infringe another person's rights. We may restrict access for a material violation, consistent with applicable law and your rights regarding purchases already made.
Our Privacy Policy, available on SamiraCaleb.com, explains how we collect, use, and disclose personal information, including information collected through advertising cookies, pixels, and similar technologies, and describes applicable privacy choices.
Accepting these Terms does not itself constitute consent to optional advertising tracking or marketing communications where separate consent is required.'
Our website may link to third-party websites, apps, or services. Their terms and privacy policies govern their own services. We are not responsible for independent third-party content or services, except to the extent responsibility cannot lawfully be excluded. Using a provider to fulfill our obligations does not eliminate your rights against us for our own performance.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL EDUCATIONAL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE FOR THAT WEBSITE AND GENERAL CONTENT TO THE EXTENT SUCH DISCLAIMERS ARE LAWFUL. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE WEBSITE ACCESS.
This disclaimer does not negate express product descriptions or promises, exclude nonwaivable warranties or remedies, or excuse delivery of defective or nonconforming purchased goods. Any applicable product-specific warranty is provided with the product or its listing.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAMIRA & CALEB LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM THE WEBSITE, PRODUCTS, OR THESE TERMS.
SUBJECT TO THE EXCEPTIONS BELOW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, personal injury caused by our negligence, or liability that cannot lawfully be excluded or limited. They do not reduce a refund or other remedy that applicable law requires. Some jurisdictions do not permit certain limitations, and those limitations will not apply where prohibited.
To the extent permitted by law, you agree to indemnify Samira & Caleb LLC for reasonable losses, costs, and expenses, including reasonable attorneys' fees, resulting from a third-party claim caused by your unlawful use of the website or knowing infringement of a third party's rights. This provision does not apply to ordinary lawful product use or claims attributable to our own negligence, misconduct, or breach of these Terms.
We will notify you of a covered claim and provide a reasonable opportunity to participate in its defense. No settlement may impose an admission or nonmonetary obligation on you without your consent.
These Terms are governed by Texas law, without regard to conflict-of-law rules, except that applicable federal law and nonwaivable consumer protections remain in effect.
To the extent permitted by law, proceedings relating to these Terms, our website, or our products will be brought in the state courts located in Harris County, Texas, or the United States District Court for the Southern District of Texas, Houston Division, if that court has subject-matter jurisdiction. This provision does not override a consumer's nonwaivable right to proceed in another court.
We encourage you to contact [email protected] first so we can try to resolve a dispute informally. Informal discussions do not prevent either party from filing a timely claim or seeking urgent relief. These Terms do not require arbitration or waive a right to bring an eligible small-claims action.
We may update these Terms prospectively by posting a revised version with a new "Last Updated" date. The version accepted when you purchase governs that purchase unless you agree otherwise. Where necessary, we will provide additional notice or request acceptance of material changes.
If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

Yes! Dual pricing is 100% legal in all 50 states when implemented correctly. The Durbin Amendment, part of the Dodd-Frank Act, explicitly allows businesses to offer discounts for cash payments as long as they are clearly disclosed. Visa and other card networks also permit dual pricing, provided merchants follow compliance rules, such as displaying both cash and credit prices prominently.
Research shows that when the payment options are clearly displayed, they feel empowered to choose what works best for them. Most customers report seeing the cash price as a reward rather than a penalty. Studies also indicate that this model can enhance trust and loyalty when communicated effectively.
Dual pricing is simple to implement with our selection of modern POS systems. These systems automatically calculate and display both prices, ensuring a smooth checkout process. Additionally, clear signage and training for your staff help avoid confusion and ensure a positive customer experience.
Not a problem! Your Free Credit Card Processing system won’t discourage card payments—it simply gives customers the power to choose. Many businesses find that offering a lower cash price incentivizes cash payments without upsetting credit card users.
